Terms of Service

1. Purpose and Scope

CoinSir (hereinafter "the Company") operates a cryptocurrency price fluctuation alert and information service. These Terms of Service (hereinafter "Terms") govern the conditions for using all services provided by the Company, and define the rights, obligations, and responsibilities between the Company and users.

Services provided:

• Real-time cryptocurrency price fluctuation alerts
• Exchange-specific surge and drop monitoring
• Customizable alert settings
• Web and mobile notifications (push, Telegram)

3. User Obligations and Prohibited Activities

Users shall not engage in the following activities:

• Disrupting the normal operation of the service
• Unauthorized use or impersonation of another user’s account
• Using the service for illegal activities or money laundering
• Causing excessive load on the Company’s servers or network
• Using automated tools (crawlers, scrapers, bots, etc.)
• Unauthorized reproduction, distribution, or commercial use of service information
• Reverse engineering, decompilation, or using the service to develop competing services

4. Account Creation and Security

Users must provide accurate information during registration and are responsible for maintaining account security (password management, etc.). Any suspected security breaches must be reported to the Company immediately.

5. Account Termination and Usage Restrictions

The Company may restrict service access or terminate accounts without prior notice in the following cases:

• Violation of these Terms
• Infringement of others’ rights or illegal use
• Use of automated tools or disruption of service operations
• Other fraudulent activities

6. Payment and Subscription

6.1 Payment Methods

• Paid plans are offered as a monthly subscription (Pro) or a one-time payment lifetime license (Founder's Lifetime).
• We accept credit/debit card payments via Creem.
• Additional payment methods (Stripe, Korean PG providers, mobile app billing, etc.) may be introduced over time. We will announce any new payment methods within the service.

6.2 Auto-Renewal

• Monthly subscriptions renew automatically on each billing cycle unless cancelled. Lifetime licenses are one-time purchases and do not auto-renew.
• We will notify you by email at least 7 days before renewal.
• You may cancel renewal at any time before the next billing date through the subscription management page.

6.3 Withdrawal and Refund

• Article 17(1) of the Korean E-Commerce Act provides a 7-day withdrawal right, but Article 17(2)(5) permits this right to be restricted once a digital content/service has been used. All of CoinSir's paid products qualify as digital content/SaaS under this provision.
• Pro monthly subscription: within 7 days + zero alerts received (service not used) = 100% refund. Within 7 days + at least 1 alert received = prorated refund. After 7 days, up to 50% of the cycle = prorated refund. Beyond 50% used = no refund for the remaining period; auto-renewal cancellation only.
• The free Basic plan during the beta period does not incur charges and is therefore not subject to refunds.
• Founder's Lifetime: within 7 days + 0 alerts received = 100% refund (E-Commerce Act). Between 7 and 30 days, a 100% refund applies if a Company-fault event occurs (monthly uptime under 95%, 7+ consecutive days of missed alerts, permanent loss of supported-exchange data, permanent discontinuation of core features, etc. — 30-Day Service Guarantee). After 30 days, refunds are issued on a prorated basis at the Pro monthly rate ($19/month) if a Company-fault event occurs. 6.4 Founder's Lifetime Limited Terms

• The campaign is limited to the first 150 buyers and will be closed when the cap is reached.
• The Company reserves the right to run different campaigns in the future (anniversaries, expanded packages, bundles, etc.) offering other forms of lifetime licenses. The same package will not, however, be resold at the same price.
• Lifetime licenses remain valid for as long as the Company operates the service. Newly added exchanges and features are included automatically at no additional cost.
• Lifetime licenses are limited to one account per buyer and are non-transferable.

6.5 Free Plan During Beta

• During the beta period prior to general availability, the Basic plan is offered free of charge. Usage caps may apply to some features.
• At general availability, the Basic plan may transition to a paid plan. We will notify users at least 30 days in advance via email and in-app announcement. Beta participants may receive specific benefits (e.g., early-adopter discounts).

7. Limitation of Liability

The Company shall not be liable for:

• Service interruptions due to force majeure (natural disasters, war, terrorism, hacking, DDoS attacks, etc.)
• Temporary downtime due to server/network failures, scheduled or emergency maintenance
• Service disruptions caused by the user’s own actions
• Investment decisions made by users based on service information, and any resulting losses
• The accuracy, completeness, or timeliness of third-party exchange API data
• Delays, omissions, or errors in alert delivery

The Company operates purely as an information service. No information provided through the service guarantees any investment outcome.

8. Disclaimer of Warranties

The service is provided on an "AS-IS" and "AS-AVAILABLE" basis. The Company makes no warranties, express or implied, regarding the accuracy, completeness, reliability, suitability, or availability of the service. This includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Damages

Except in cases of willful misconduct or gross negligence, the Company’s total liability to any user shall not exceed the total service fees paid by that user during the 12 months preceding the claim.

The Company shall not be liable for indirect, incidental, special, or consequential damages (including lost profits, lost data, or investment losses).

10. Restriction on Minors

This service is available only to users aged 19 or older (or the legal age of majority in the user’s jurisdiction). Accounts found to violate this policy will be immediately deleted. Legal guardians may request the cessation of a minor’s data processing.

11. Intellectual Property

All intellectual property rights in the service content (text, graphics, logos, software, designs, etc.) belong to the Company or its licensors. Users are granted a personal, non-commercial license to use the service. No content may be reproduced, distributed, modified, used to create derivative works, publicly displayed, or sold without the Company’s prior written consent.

12. Third-Party Services

The Company may provide links or integrations to third-party services (Binance, Bybit, OKX, Kraken, Creem, Google, Telegram, etc.). These services are governed by their own terms and policies, and the Company has no control over or responsibility for their use.

13. Data Source Disclaimer

All market data is sourced from public APIs (WebSocket/REST) of major cryptocurrency exchanges including Binance, Bybit, OKX, and Kraken. While we strive for accuracy, we do not guarantee and are not liable for delays, outages, or data inconsistencies originating from exchange APIs.

14. Restricted Countries

Due to exchange terms of service and local regulations, service access may be restricted in the following countries and regions:

• Cuba
• Iran
• North Korea
• Syria
• Crimea

16. Changes to the Terms

The Company may amend these Terms within the scope permitted by applicable law. Changes will be announced through the service at least 7 days before the effective date (30 days for changes unfavorable to users).

Users who disagree with amended Terms may stop using the service and withdraw their membership. Failure to express objection within the notice period constitutes consent to the changes.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.

In case of disputes arising from service use, the Company and users shall negotiate in good faith. If no agreement is reached, disputes shall be resolved by the competent court under general civil procedure law.

For users residing outside Korea, mandatory consumer protection laws of the user’s jurisdiction may apply, and nothing in these Terms shall limit the user’s rights under such mandatory provisions.

18. General Provisions

• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Entire Agreement: These Terms constitute the complete agreement between the Company and users regarding service use, superseding all prior oral or written agreements.
• No Assignment: Users may not assign their rights or obligations under these Terms to any third party without the Company’s prior consent.
• No Waiver: The Company’s failure to immediately enforce any provision of these Terms shall not constitute a waiver of that right.
